Terms of Service

These Terms of Service (“Terms”) are a contract between you and NetaSampark Technologies Private Limited (“NetaSampark”, “we”, “us”) for use of netasampark.com and related services (the “Platform”). Please read them together with our Privacy Policy and Cookie Policy.

1. Acceptance

By accessing or using the Platform you agree to these Terms. If you use the Platform on behalf of an organisation, you confirm you have authority to bind that organisation. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old and capable of entering a contract under Indian law. Leader or campaign accounts may require additional verification or a separate agreement.

3. What NetaSampark is

NetaSampark is an independent civic technology platform. We help citizens discover elected representatives, understand public records, participate in polls and ideas, and rate public performance through the Neta Trust Score™.

NetaSampark is not:

• A political party, candidate, or government body;
• The Election Commission of India or any state election authority;
• A source of official electoral or legal advice;
• A guarantor of electoral or policy outcomes.

4. Directory and public information

Representative profiles combine public records with editorial and community content. We strive for accuracy but do not warrant that every field is complete or current. Official records remain authoritative. Report factual errors through profile tools or Contact us.

5. Accounts and security

You are responsible for credentials on your account and for activity under it. Notify us promptly of unauthorised use. We may suspend accounts that appear compromised or abusive.

6. Acceptable use

You agree not to:

• Harass, threaten, or defame any person, including representatives or other users;
• Submit false ratings, ballot-stuffing, or coordinated inauthentic feedback;
• Scrape, bulk-download, or resell directory data without written permission;
• Attempt to bypass contact gating, rate limits, or security controls;
• Upload malware, spam, or unlawful content;
• Violate election laws, telecom rules, or platform policies of integrated providers.

Ratings and comments should reflect your genuine experience of a representative’s public work, not private vendettas or hate speech.

7. Ratings, polls, and user content

You retain ownership of content you submit, but grant us a worldwide, royalty-free licence to host, display, moderate, and analyse it to operate the Platform. We may remove content that violates these Terms or applicable law. Poll and idea results may be shown in aggregate; individual votes may be stored to prevent duplicate participation.

8. Neta Trust Score™

The score is a summary of citizen ratings on NetaSampark, not an official government rating. With few ratings we label scores as early. Do not misrepresent the score in advertising or campaigning without context.

9. Leader and Command Center services

Optional tools for representatives, parties, or organisations may have additional fees, data-processing terms, or acceptable-use rules. Where a signed order form or data processing agreement exists, it prevails over conflicting general Terms for that customer.

10. Third-party services

The Platform may link to or integrate third-party sites (social networks, payment gateways, messaging providers). Their terms and privacy practices apply to your use of those services.

11. Intellectual property

NetaSampark logos, software, and site design are our property or our licensors’. Public-record facts and representative names are not owned by us. You may not copy our branding or code except as allowed by law or written permission.

12. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ANALYTICS, AI SUGGESTIONS, AND COMMUNITY CONTENT MAY BE INACCURATE OR INCOMPLETE.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) INR 5,000, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

14. Indemnity

You will defend and indemnify us against claims arising from your content, your misuse of the Platform, or your violation of these Terms or applicable law, except to the extent caused by our gross negligence or wilful misconduct.

15. Suspension and termination

We may suspend or end access for breach, risk to users, or legal requirement. You may stop using the Platform at any time. Sections that by nature should survive will survive termination.

16. Governing law

These Terms are governed by the laws of India. Courts in Bengaluru, Karnataka shall have exclusive jurisdiction, subject to mandatory consumer protections that apply where you live.

17. Changes

We may update these Terms. We will post the new version with an updated date. Material changes may be notified on the site. Continued use after changes means acceptance.
